Penalties For A Drug Possession With Intent To Sell Conviction In Arizona

Being charged with a drug possession crime could lead to being charged with multiple drug related crimes. Some of the common crimes that are tied together are possession, possession with intent to distribute and possession with the intent to sell. Possession with intent to sell can have varying penalties depending on the specific details of the case. Some of the penalties you could face if convicted are:

  • Marijuana Charges (ARS §13-3405): If there was less than 2 pounds, then it would be deemed as a Class 4 Felony and would have a 1.5 to 3 year prison sentence. If it was between 2 and 4 pounds, then it would be deemed as a Class 3 Felony and would come with a prison sentence of 2.5 to 7 years. If the charge was more than 4 pounds, then it would be a Class 2 Felony and would come with a sentence of 4 to 10 years. Within all of these charges, there would be a fine of $750 or 3 times the amount of the value.

  • Dangerous Drugs & Narcotics (ARS §13-3407): This would be deemed as a Class 2 Felony and would bring the potential of 4 to 10 years in prison. For dangerous drugs, you could also face a $1,000 fine or 3 times the value of the drugs. Narcotics would come with a $2,000 fine or 3 times the value of the drugs.

  • Prescription Drugs (ARS §13-3406): This would be deemed as a Class 6 Felony and can come with between 6 months and 1.5 years in prison. You could also be fined $1,000 or 3 times the value of the drugs.
