Penalties & Consequences of A Domestic Violence Conviction In Scottsdale

Domestic violence charges can lead to misdemeanor or felony convictions, depending on the severity of the offense and other factors. Misdemeanor convictions generally result in less severe penalties, such as probation, fines, mandatory counseling or anger management classes, and protective orders. The court may require you to complete a domestic violence offender treatment program aimed at addressing the underlying issues related to your behavior. Additionally, you may be subject to supervised probation, which involves regular check-ins with a probation officer to ensure compliance with court orders and conditions.

Felony convictions for domestic violence offenses can carry more significant penalties. These may include imprisonment, extended probation periods, substantial fines, and mandatory counseling or treatment programs. Felony convictions can have long-term consequences, impacting employment opportunities and other aspects of your life. Some other consequences you could face include:

  • Protective Orders: In domestic violence cases, the court may issue protective orders or restraining orders to protect the alleged victim from further harm. These orders impose various restrictions on the accused party, including prohibitions on contact, imposing distance requirements, and preventing possession of firearms. Violating a protective order can result in additional criminal charges and penalties. It is crucial to comply with all court-ordered restrictions to avoid further legal consequences.

  • Family Consequences: Domestic violence charges can have significant implications for family matters, particularly in the context of divorce, child custody, and visitation. If you are involved in a divorce or custody dispute, a domestic violence conviction can impact child custody and visitation arrangements. The court may limit or supervise your access to children to ensure their safety and well-being. Additionally, a domestic violence conviction can influence spousal support determinations and the division of assets during divorce proceedings.

It's important to remember that the consequences of domestic violence charges can vary depending on the specific circumstances of the case, the severity of the offense, prior criminal history, and other factors. Consulting with an experienced domestic violence defense attorney in Scottsdale is crucial to understanding the potential consequences you may face and developing a strong defense strategy tailored to your situation. An attorney will guide you through the legal process, protect your rights, and work towards achieving the best possible outcome in your domestic violence case.

Legal Process for Domestic Violence Charges in Scottsdale

When domestic violence is reported, law enforcement will investigate the allegations and gather evidence. If there is sufficient evidence, the prosecutor's office may file charges. The legal process typically involves the following steps:

  1. Arrest: If the police believe there is evidence of domestic violence, they may make an arrest at the scene or after conducting an investigation.
  1. Initial Appearance: After an arrest, the accused is brought before a judge for an initial appearance. At this stage, the judge informs them of the charges, reviews their rights, and sets conditions for release, such as bail or bond requirements.
  1. Pretrial Proceedings: The defendant and their attorney will engage in pretrial proceedings, which may include plea negotiations, gathering evidence, filing motions, and preparing a defense strategy.
  1. Trial: If the case proceeds to trial, both the prosecution and defense present their evidence, call witnesses, and make arguments before a judge or jury, who will determine guilt or innocence.
  1. Sentencing: If found guilty, the court will impose penalties, which can include probation, fines, mandatory counseling or treatment programs, protective orders, or incarceration, depending on the severity of the offense and other factors.

Defenses Against Domestic Violence Charges

If you are facing domestic violence charges in Scottsdale, it is crucial to consult with an experienced domestic violence defense attorney. They can evaluate the specific circumstances of your case and develop a defense strategy tailored to your situation. Common defenses may include challenging the credibility of the alleged victim, presenting evidence of self-defense, disputing the evidence or witness testimony, or highlighting procedural errors that can weaken the prosecution's case.

Our Case Results

Second Time DUI

Woman was charged with her second DUI within 7 years after being involved in a collision in Scottsdale. Through our investigation, we found multiple mistakes made by the arresting officer. These errors were used to get the prosecution to reduce the alleged offense to a charge with no jail time. Result: Charge Reduced w/ No Jail.

Drug DUI

A man was pulled over by Salt River Police Department while visiting from out of town. Despite showing no signs of impairment, the officers arrested him and charged him with DUI Drugs. We investigated the case heavily and interviewed every officer involved. Ultimately, a motion to suppress was filed and granted after an evidentiary hearing before a Judge. Result: Case Dismissed.

Aggravated Assault

A man was charged with attacking a family with a knife. After reviewing the evidence, it was determined that the instrument used was not a knife at all. The Grand Jury had been misled, so we filed a motion challenging the grand jury presentation. The prosecutor, confronted with the truth, agreed to reduce the charge to a misdemeanor with no jail time. Result: Charge Reduced to a Misdemeanor.

A man was out on a walk and was stopped by police because he was in the area of an attempted vehicle theft. The man maintained his innocence, but the owner of the truck identified him as the man he saw attempt to steal it. We worked tirelessly to prepare a defense and get the prosecution to see reason. The State wouldn’t budge, so the case went to trial. Result: Not Guilty After Jury Trial

Resisting Arrest

A client was charged with resist arrest after being targeted by police during the protests of Summer 2020. Our firm developed a strategy with activists and members of the media that led to a dismissal of our client’s case and, eventually, all cases connected to the political prosecution of the protesters. Result: Case Dismissed.

Domestic Violence

A woman and her boyfriend were arguing over the cleaning of their apartment. The police were called after things escalated and the woman was arrested. The Mesa City Prosecutors originally wanted the woman to do jail time. After working the case and providing background information, we were able to get the prosecutor to allow the woman to complete classes in exchange for a dismissal. Result: Case Dismissed After Diversion.
